Terms of Use (EULA)

1. Acceptance of these terms
These Terms of Use (this “Agreement”) govern your access to and use of iemstudentexchange.com and any related online forms, portals, and content operated by IEM Student Exchange (“IEM,” “we,” “us”) (together, the “Site”). By using the Site or submitting an inquiry or application through it, you agree to this Agreement. If you do not agree, please do not use the Site.
2. License to use the Site
Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site for your personal, non-commercial purpose of learning about and applying to our programs. All rights not expressly granted are reserved.
3. Restrictions
You may not, and may not permit others to:
- copy, modify, translate, or create derivative works of the Site or its content, except as expressly permitted;
- reverse engineer, decompile, or disassemble any part of the Site, except where this restriction is prohibited by law;
- scrape, harvest, or collect information about students, families, host families, or staff from the Site;
- rent, lease, sell, sublicense, or otherwise transfer access to the Site;
- circumvent or disable any security or access-control feature;
- use the Site to violate any law or the rights of others, or to submit false, misleading, or fraudulent information; or
- use the Site to build a competing product or service.
4. Inquiries and applications
Submitting an inquiry or application through the Site does not create a placement, enrollment, or contract of any kind. Programs, schools, housing, availability, dates, and fees are subject to confirmation and to separate written agreements. Any placement is subject to school admission decisions, host-family availability, and applicable immigration requirements. You agree that the information you submit is accurate and that you are authorized to submit it — including, for a student under 18, that you are a parent or legal guardian or are acting with their authorization.
5. Eligibility
You must be at least 18 years old and able to form a binding contract to submit forms through the Site. A parent or legal guardian must submit on behalf of a student under 18 and is responsible for that submission.
6. Third-party services and links
The Site uses third-party services, including HubSpot for forms and customer relationship management, embedded video from platforms such as YouTube and Vimeo, and an optional machine-translation widget. The Site also links to partner schools, colleges, and housing partners. Those services and sites are operated by others under their own terms and privacy policies, and we are not responsible for their content, availability, or practices. Machine translation is provided for convenience only; the English version of the Site controls in the event of any discrepancy.
7. Intellectual property
The Site, including its text, design, graphics, photographs, video, and software, is owned by IEM or its licensors and is protected by intellectual-property laws. “IEM Student Exchange” and related names and logos are our property. School names and logos shown on the Site are the property of their respective owners and are used to identify our partners.
8. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of this Agreement.
9. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT PROGRAM, SCHOOL, OR HOUSING INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT. NOTHING ON THE SITE IS IMMIGRATION, LEGAL, FINANCIAL, OR MEDICAL ADVICE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IEM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, AND THEY DO NOT LIMIT ANY RIGHTS UNDER A SEPARATE SIGNED PROGRAM AGREEMENT.
11. Suspension and termination
We may suspend or terminate access to the Site at any time if you violate this Agreement or to protect the Site, our students, or our partners. Sections that by their nature should survive termination — including Sections 7 through 10 and 12 — will survive.
12. Governing law
This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in San Diego County, California.
13. Changes to this Agreement
We may update this Agreement from time to time. Material changes will be posted on this page with a new effective date. Continuing to use the Site after changes take effect means you accept them.
